These Terms of Service ("Terms") govern your access to and use of AuraSea OS, including the website at auraseaos.com and the application at app.auraseaos.com (collectively, the "Service"), provided by AuraSea Co., Ltd. ("AuraSea," "we," or "us"). By using the Service, you agree to these Terms.
1. Account and eligibility
You must be at least 20 years old and authorized to enter into a binding agreement on behalf of your business. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. Service description
AuraSea OS provides operational intelligence tools — including daily briefings, anomaly alerts, recommendations, and reports — based on data you connect or enter into the Service. We may add, remove, or modify features over time. Material changes that reduce core functionality will be announced 30 days in advance.
3. Subscriptions and billing
Paid plans are billed monthly or annually in Thai Baht (THB). You authorize AuraSea (and our payment processor, Omise) to charge your payment method for the agreed subscription fee. Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel anytime; your subscription remains active until the end of the current billing period.
Refunds: Annual subscriptions are non-refundable except where required by law. Monthly subscriptions are non-refundable. We may issue prorated refunds at our discretion in cases of significant service outage.
4. Free trials
We may offer free trials. At the end of the trial period, paid subscriptions begin only if you have provided payment information and confirmed activation. We will not auto-charge a payment method without explicit consent.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to access another user's account or data without authorization
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Use the Service to send spam or unsolicited communications
- Interfere with or disrupt the Service, including via denial-of-service attacks
- Resell, sublicense, or transfer the Service to third parties without our written consent
6. Your data
You retain ownership of all data you upload, enter, or connect to AuraSea OS ("Customer Data"). You grant AuraSea a limited license to process Customer Data solely to provide the Service to you. We process personal data in accordance with our Privacy Policy.
7. Intellectual property
AuraSea OS, including all software, designs, branding, and documentation, is owned by AuraSea Co., Ltd. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during your active subscription. This license does not transfer ownership of any AuraSea property to you.
8. Service availability and support
We aim for high service availability but do not guarantee uninterrupted operation. Scheduled maintenance is announced in advance when possible. We provide support via email, LINE Official Account, and during business hours (Mon-Fri, 9am-6pm Bangkok time).
9. Disclaimers
AuraSea OS provides decision support; it does not make decisions for you. Recommendations are based on the data available and historical patterns; you remain responsible for all business decisions. The Service is provided "as is" without warranties of any kind, except where required by Thai law.
10. Limitation of liability
To the maximum extent permitted by Thai law, AuraSea's total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or lost revenue.
11. Termination
You may terminate your account at any time. We may terminate or suspend your account if you violate these Terms or fail to pay subscription fees, with reasonable notice except in cases of serious violation. Upon termination, your access to the Service ends; we will delete your data within 90 days unless legally required to retain it.
12. Governing law and disputes
These Terms are governed by the laws of Thailand. Any disputes will be resolved in the courts of Bangkok, Thailand, except where Thai consumer law requires otherwise.
13. Changes to Terms
We may update these Terms. Material changes will be announced via email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
